Is Your AI Provider Hiding Behind Legal Loopholes? Why Accountability is the Most Critical Ethical Pillar of AI

One of the four pillars of “responsible” or “ethical” AI is accountability. (I put those in quotes because they’re such squishy terms)

Accountability is simple: someone stands behind what the machine does. Like all things, you make your best faith effort to ensure the machine does what it says it does, you inform the user of the risks, and if the machine does something you should have foreseen and prevented, you accept the responsibility, the accountability for what is functionally neglect.

For example, in firearms, leaving a loaded, unlocked, unsecured firearm in your household is dangerous neglect. Your best faith effort would be a locked safe, and the firearm unloaded and stored within that safe. In vehicle ownership, an unmaintained car is a hazard to you and everyone around you. Your best faith effort would be a well-maintained car that has key systems like brakes checked and replaced before they fail.

Yesterday, Macy Kittelberger asked about a new AI service that claims to be designed for therapy. While I believe LLMs can be used WITH professional supervision by a skilled therapist paired with a skilled technologist, a SaaS-based offering marketed as a therapy replacement had better come with some strong accountability.

So what do you suppose I found when I checked the terms of service for this app? THREE PAGES of legal deflection. Eyeballing it, close to 1/3 of the Terms of Service is entirely dedicated to the abdication of responsibility, of dodging accountability in any form.

When you need a third of your Terms of Service to dodge accountability, that’s an indicator your product is not responsible AI. Yes, you have to protect against frivolous lawsuits, unquestionably. Yes, your legal team will insist on maximum protections, as they should. That’s their job.

But would you ever go to a doctor who said, “I disclaim any advice I give you”? Would you go to a surgeon who said, “I’m not responsible for what I cut out of you”? Would you go to a dentist who said, “Whatever happens, it’s not my fault as I work on you”? I would hope not.

Responsible AI is built on accountability. If you aren’t accepting accountability, you and your AI are not behaving responsibly.
