Senate Slams Big Tech: 99-1 Vote Blocks AI Regulation Ban, Paving Way for State-Led Controls

Yesterday, the USA Senate voted 99-1 against a proposed ban on states to levy their own AI regulations.

The proposed legislation would have banned individual states from regulating AI at the state level for 10 years.

Big Tech had championed this initiative, hoping to ease regulation on AI (especially with the current administration). The second order goal of the legislation was to effectively cripple regulation of AI in the USA, allowing Big Tech firms to lobby and pay off just federal government folks to get their way.

But a 99-1 vote by the Senate – an exceptionally rare alignment – told Big Tech to take a hike.

In a world where we can hardly agree on anything, this is quite surprising but highlights the fact that people across the political spectrum are concerned about AI’s capabilities, the companies that make it, and don’t trust the federal government to regulate it effectively (nor should they).

What this means on a practical level will look a lot like GDPR – a patchwork quilt of regulations in different states, with some states having far more permissive or far more restrictive rules. The general best practice is to adhere to the strictest rules so that you’re compliant across the board.

What those rules will be, we don’t know yet. It’ll be a medley of confusion, because in general politicians rarely understand technology well enough to regulate it effectively (see: social media, the Internet).

However, in the current environment, giving more latitude to regulation rather than less is the right move, and I’m glad to see it.
