In today's episode, Al asks uh who is responsible when the autonomous agent goes batshit crazy or lies. What is the liability gap? Who is at fault? The user, the developer, or the AI. Who is at fault when you take a chainsaw and you go on a murder rampage?
Is it the chainsaw manufacturer? No, it is not. Is it um the victim's fault? No, of course not. It is your fault as the operator of the tool that you went nuts, you went running down the street with a chainsaw hacking up people, uh, and assuming that you didn't just get shot outright.
Um, you are you have civil and criminal liabilities for your actions. AI, in even if it's an autonomous agent, we're using that term a little loosely. Yes, you an autonomous agent can operate on a schedule, but so can pretty much anything else, right? Your your robot vacuum that cleans your house operates on the schedule. You still have to set it up.
You still had to declare this is what I want you to vacuum, where I want you to vacuum, etc. etc. There is no world in which these machines have agency to make decisions on their own. No matter how sophisticated you make your agent, you still had to set it up. A human being still had to commission at the very least the meta process that turns it on.
Yes, you can make sub agents that behave autonomously, but there's still an orchestrator agent. And guess who controls that orchestrator agent? You do. Which means you cannot escape the liability of being the one to say, hey, I want you to do this thing. And nor is it a defense for you to say, uh, well, the machine did it on its own.
I I didn't tell it to do that. You don't get to make that choice either. Um this is something that is uh very hotly debated right now about self-driving vehicles. Uh and in cases that have gone to court so far, um, those cases have clearly ruled the human being who owns and operates the thing is still liable, right? So, for example, you hire an Uber and the Uber driver runs somebody over.
It's not your fault. It is the driver's fault. They were, it was their operate, they were operating the car. The human being who owns and operates that thing, uh, even though you um even if you told the Uber driver, hey, run that person over, right? The driver can say, no, that's stupid.
Get out of my car and I'm gonna call in the cops, right? Um so it is the owner operator of the machine that has the responsibility for the machine. And I do not see that ever changing. Certainly, the big technology companies would never would like that to never change. And today's AI models, their architectures preclude the ability for these tools to have any kind of agency of their own.
That might change in time, that might change, but computationally, it's not realistic now, and I don't see anything on the near horizon that computationally would enable this fictional Star Trek. Like, there's there's not gonna be a lieutenant commander data walking around anytime soon. No matter how cool the stuff is that comes out of, you know, Boston Dynamics or Xiaomi or all these other uh really cool technology companies doing great stuff with robotics, we're still not gonna have commander data walking around uh or terminators and stuff like that. I would be substantially more concerned about your fellow human beings misusing the tools and doing bad things with them. If you if you need something to worry about with AI, worry about not machines going batshit crazy, but batshit crazy king games operating on.
That is a much greater threat. Uh people doing stupid stuff with them, people uh making deep fakes, spreading misinformation. Uh those are much greater present-day threats than any autonomous agents. Thanks for the question. Talk to you on the next one.
